On September
2017, as per a publication from BuzzFeedNews, a teenager, Anna, was under the
custody of two police officers who raped her during their shift.
Anna
reported this event, “But Anna didn’t know that in New York, there is no law
specifically stating that it is illegal for police officers or sheriff’s deputies
in the field to have sex with someone in their custody. It is one of 35 states
where armed law enforcement officers can evade sexual assault charges by
claiming that such an encounter — from groping to intercourse — was consensual”
This
statement is not totally true and it has been discovered that there is a
loophole in the law. “the state statute prohibiting sexual
contact between corrections officers and parole officers and those in their
custody does not expressly rule out sexual contact between police officers and
people they detain or arrest” There is a lack of a law that prohibits cops to have sex with
the detainees; there is no law that “allows’ this crime to be committed.
States
need to review their laws to avoid anything like this to happen again. Their job is to protect the citizens, not to
abuse them.
